PREZZEE EGIFT CARDS PRIVACY POLICY
Prezzee Canada Corporation (1608791-4), incorporated in Ontario, Canada (“Prezzee” or “our” or “we”) is in the business of providing the online platform enabling the purchase, redemption, management and storage of a variety of non-reloadable digital gift cards and codes and associated services (the “Services”). The Services include, and may be provided through, our website (the “Prezzee Site”) or mobile application (the “Prezzee App”).
This Privacy Policy (“Policy”) makes disclosures concerning our collection of personal information, purposes of collection, sources of collection, and measures we use to protect your personal information. In this Policy, personal information means any information that identifies, relates to, describes, is reasonably capable of being associated with or could reasonably be linked, directly or indirectly, with a particular consumer or household (“Personal Information”).
This Policy applies to Personal Information collected by Prezzee in connection with our provision of the Services, including Personal Information collected through the Prezzee Site, Prezzee App, our social media accounts, and other technological means. Prezzee uses third parties (sub processors) located both locally and outside of your jurisdiction of residence in addition to its own resources to provide the Services.
This Policy does not apply to information collected on any website operated by us that does not link to this Policy, any website or mobile application operated by a third party, or through any third party application or content that may link to or be accessible from the Services.
Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not use our Services. By accessing or using our Services, you agree to this Policy. This Policy may change from time to time, and the most recent update will appear here. Your continued use of the Services after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.
We understand that when accessing our Services, the privacy and confidentiality of Personal Information is important to you. That’s why we fully respect your rights to privacy and are committed to protecting the personal and financial details you provide us in line with this Privacy Policy. This Privacy Policy applies to our Services and all individuals who use our Services or whose Personal Information is processed by Prezzee in connection with the Services.
We are committed to protecting the privacy of everyone who uses our Prezzee App and/or our Services, for them to understand what Personal Information we collect and store, and why we do so, how we receive and/or obtain that information, the rights an individual has with respect to their Personal Information in our possession, and with complying with the requirements of applicable privacy laws (“Privacy Laws”).
Children under the age of 13 are not permitted to use the Services or Prezzee Apps. No one under age thirteen (13) may provide any Personal Information to, or on the Prezzee Apps. We do not knowingly collect personal information from children under thirteen (13). If you are under thirteen (13), do not use or provide any information on our Prezzee Apps or through any of its features, register on our Prezzee Apps, make any purchases through the Prezzee Apps, use any of the interactive or public comment features of this Prezzee Apps, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under thirteen (13) without verification of parental consent, we will remove and delete that information. Information is collected directly from you in association with your use of the Services, when you make an inquiry about Prezzee or generally deal with us directly or via our Services. If you are a Gift Card recipient, Personal Information is collected from the person who purchased the Gift Card.
As you navigate through and interact with the Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including details of your visits to the Services, including traffic and location data, and information about your computer, device and internet connection, including your IP address, operating system, and browser type.
We will not use any Personal Information other than for the purpose for which it was collected and with the individual’s permission or as otherwise outlined in this Policy.

An individual may opt to not have us collect their Personal Information (for example by unsubscribing to any marketing emails received). This may prevent us from offering them some or all of our services and may terminate their access to some or all of the services they access with or through us.

We may use your Personal Information in de-identified form (de-identification being a process by which a collection of data or information is altered to remove or obscure personal identifiers and personal information) to assist us in performing services. We may also provide, including by way of sale, de-identified information in aggregated form, to third parties.
When your Personal Information is included in de-identified, aggregated data, it is not possible to identify you or anything about you from that data.
We may use temporary (session) cookies or permanent cookies when you access our Online platforms and/or Services. This allows us to recognize your browser and track the web pages you have visited. Some of these cookies also help improve your user experience on our websites, assist with navigation and your ability to provide feedback and assist with our promotional and marketing efforts. You can switch off cookies by adjusting the settings on your web browser.
In addition to cookies, Prezzee will utilize tracking pixels. The current list of tracking pixels is as follows:
Prezzee provides the ability to prevent the operation of all but essential Prezzee cookies and tracking pixels through a cookie disclaimer banner which is presented across all of its websites, and remains persistent until a choice is selected by the website visitor.
Prezzee utilizes Giftomatic Websnippets across all of its websites, which consists of Javascript functionality to display products from Giftomatic Affiliates.
If you would like us to update or amend your personal information, or would like to request access to your Personal Information, please contact us on the contact details set out in Section 18. Please note that these rights are not absolute, and are subject to applicable legal restrictions.
We may ask you to verify your identity to ensure that personal information we hold is not improperly accessed.
You can log-in to the Service by signing into social networks such as Facebook or an Open ID provider. Providers such as Facebook provide the option of posting and sharing information with others within your social network. If you stop using the network from which you signed in to use the Service, you agree that we will still retain the Personal Information from the social network that you provided us access to in accordance with this policy.
Social media features such as Facebook Like and Share buttons and widgets and interactive mini-programs which run within the service may collect your IP address and set a cookie to enable the feature to function properly. Your interaction with these features is under the Privacy Policy of the company providing them.
You have the right to delete your account or request the deletion of your Personal Information, subject to certain exceptions. Prezzee gives you the ability to permanently delete your account or Personal Information at any time.
You may notify us about your wish to delete your Personal Information or your account at the contact details in this Privacy Policy or follow in-app prompts. All requests must be in writing.

If we have a dispute regarding an individual’s Personal Information, we both must first attempt to resolve the issue directly between us.
If we become aware of any unauthorized access to an individual’s Personal Information we will inform them and any supervisory authority as required, at the earliest practical opportunity once we have established what was accessed and how it was accessed.
Prezzee provides a geo-push notification feature to customers using its mobile app to send them servicing messages and/or special offers from select retailers based on the close proximity of the customer to that retailer. The app requires access to the location services on the mobile device in order to utilize this feature and must be manually enabled by the customer firstly. Prezzee does not retain real time location data of the customer and does not use location services and data for any other purpose.
To the extent that Prezzee provides location based features as part of the Services, it may collect, use, and share precise location data, including the real-time geographic location of your computer or device. Where available, location-based services may use GPS, Bluetooth, and your IP Address, along with crowd-sourced Wi-Fi hotspot and cell tower locations, and other technologies to determine your devices’ approximate location. Unless you provide consent, this location data is collected in an anonymized form that does not personally identify you.

Prezzee takes the security and privacy of your Personal Information seriously and has prepared this privacy policy and taken measures to collect, process and hold all Personal Information in compliance with United States privacy laws and GDPR regardless of the user. Therefore, no additional terms for GDPR users are required.
Prezzee employs sub processors to process your personal data. The sub processors may be located outside of the UK/EEA and operate in countries that do not have an adequacy decision, and are as such classed as restricted transfers. Where personal data of citizens of the UK/EEA is processed by Prezzee in countries without an adequacy arrangement in place, such transfers are undertaken under the protection of model clauses.
We reserve the right to amend this Privacy Policy at our discretion and at any time. When we make changes to this privacy policy, we will post the updated notice on the Website and update the notice’s effective date. Your continued use of our Website following the posting of changes constitutes your acceptance of such changes.

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our App that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. The California Consumer Privacy Act provides California consumers with the right to obtain Prezzee information about the Personal Information that we collect, use, and disclose. You can exercise your right by contacting Prezzee in any manner set forth in Section 18.
We do not discriminate against a consumer because of the exercise by the consumer of any of their privacy rights such as right to access, deletion or opt-out from sale or sharing of your personal information. This means that we will not, because of the exercise of consumer privacy rights granted by the CPRA:
You have the right to opt-out of the sale of your personal information. Prezzee does not sell your Personal Information, other than in de-identified form.
We limit internal access to Personal Information to our personnel who require access for the purposes described in this Privacy Policy, including personnel in our customer service, marketing, technology, finance, security, audit and legal departments. We also have policies and procedures regarding our handling of Personal Information that are designed to facilitate our compliance with this Privacy Policy and applicable laws, including policies and procedures regarding access to Personal Information, retention of Personal Information, and handling of complaints.
