In your purchase of Retailer eGift Cards and/or Prezzee Smart eGift Cards (together, “eGift Cards”) from Prezzee, you agree to be bound by these Terms of Sale (including any disclosures made to you at the time of purchase and/or when the eGift Card is provided to the recipient) (“Terms”) effective at the time of your purchase, including the Retailer terms and conditions, our Privacy Policy and Terms of Service which are incorporated in these Terms by reference. If you do not agree to all of these Terms, do not make any purchases from Prezzee or use our Services.
Prezzee Canada Corporation, 320 Glenayr Road Toronto ON M5P 3C5 (“Prezzee,” “we” or “us”) enables access to your mobile application (“Prezzee App”) and our website (“Prezzee Site”) where a user can buy, send, redeem, manage and store Retailer eGift Cards and Prezzee Smart eGift Cards and receive other services or offers from time to time as determined solely by Prezzee (collectively, the “Services”).
Please read this document carefully as these Terms, and the other documents incorporated by reference which form part of these Terms, describe the legally binding agreement between you and Prezzee that apply to your purchase through the Prezzee Site or the Prezzee App. The date of the agreement is the date you purchase an e-Gift Card. In addition to the disclosures provided to you when you purchase an eGift Card (such as, information regarding the eGift Card and related Retailer terms and conditions, all applicable fees, charges and related costs, if any, total purchase price, payment terms and delivery arrangements), these Terms also include the details of any warranties or guarantees that apply to your purchase, cancellation, return, exchange and refund policies, if any, and all other restrictions, limitations or conditions of purchase that may apply.
You agree to receive, in electronic form, a copy of these Terms, any required disclosures and all other notices, information or communications we may be required to send to you from time to time under applicable law. You agree to keep a copy of any electronic communications, including a copy of these Terms, for your records and future reference. Any notices or other communications will be deemed to be delivered when emailed to your designated email address, as provided or updated by you from time to time.
Except if you are a consumer that resides in Ontario or you are a Quebec consumer or an individual recognized as a consumer by Quebec courts, in which case the paragraph below will apply for all changes made to these Terms, we reserve the right to change or modify these Terms at any time in our sole discretion. Should we make changes to these Terms, notice may be provided by sending you a notification, providing notice through the Services, or by updating the “Last Updated” date at the top of these Terms. Review these Terms each time you make a purchase from Prezzee to ensure that you understand the Terms applicable to your purchase.
For Ontario and Quebec Consumers and Individuals Recognized as Consumers by Quebec Courts only. Notwithstanding the foregoing and any other provision in these Terms that refers to our right to change or amend the Terms, if you are a consumer that is located in the province of Ontario or Quebec, we reserve the right to amend these Terms with respect to any provisions that apply to the Services offered, any related fees or charges, the Prezzee App, Prezzee Site, eGift Cards available, our responsibilities or obligations under these Terms, your responsibilities under these Terms, any disclaimers, limitation of availability and indemnification (collectively, "Changes") every six (6) months. If we make Changes to these Terms, in addition to posting the revised Terms on the Prezzee Site, we will also provide you at least thirty (30) days’ advance notice of such amendments in accordance with applicable law ("Notice"). Upon receiving the Notice, if you do not agree with the amendments, you must stop using the Services and you may refuse the amendments and terminate your relationship with us and the related contracts by sending us a notice to that effect within the time specified in the Notice (and, if you are a consumer or individual recognized as a consumer by Quebec courts and you reside in Quebec, the Notice can be sent within thirty (30) days after the effective date of the Change if the Change entails an increase in your obligation or a reduction of our obligations). If you do not notify us within the required time, the Changes will take effect, as indicated in the Notice. In that case, you will be deemed to agree to the Changes which will become part of these Terms and enforceable against you. If you terminate your relationship with us, we will no longer provide Services to you, but you will continue to be liable for any amounts owing to us and all provisions that by their nature are intended to survive termination of the Terms will continue to apply.

A variety of non-reloadable Retailer eGift Cards from over hundreds of top Canadian brands are offered for purchase through our Services. All Retailer eGift Cards are subject to availability, and we reserve the right to impose quantity limits on any order, reject all or any part of an order and to discontinue products without notice, even if you have already placed an order.
All prices are subject to change without notice. The price charged will be the price set out on the Service at the time of your order. The minimum price of an eGift Card sold via Prezzee is $5.00 and the maximum price is $500.00 (subject to each Retailer’s minimum and maximum limits). If you purchase multiple eGift Cards on a single day, the total amount that you purchase on all the cards cannot exceed $10,000. eGift Cards purchased through Prezzee are available for use within Canada and may be available for use in or sending to recipients in other countries. Please consult the Prezzee eGift Card wall via the Service and each Retailer’s terms and conditions for the use of Retailer eGift Cards outside of Canada are displayed. The Retailer eGift Card you select is subject to the Retailer’s own separate terms and conditions in addition to these Terms.
From time to time, we may offer other special promotions intended to provide you an incentive to purchase eGift Cards and/or to encourage you to get others to do so. The applicable rules will be posted on the Prezzee Site in or near the description of each such promotion. We reserve the right to interpret these rules in our sole discretion and to cancel any promotions without notice.
The expiration date for an eGift Card, if one applies, is displayed on the back of the eGift Card in your Prezzee Wallet or in the Retailer’s own terms and conditions. Please refer to the expiration date to ensure you redeem your eGift Card in the allocated time frame. Prezzee is not responsible for eGift Cards that are not redeemed before the expiration date.
Unless otherwise required by law, eGift Cards are not redeemable for cash.
Each eGift Card purchased by you will be listed as a separate eGift Card in your Prezzee Wallet. By way of reference, in the event you purchase two eGift Cards from the same retailer, your Prezzee Wallet will reflect two separate eGift Cards, as opposed to one eGift Card. Prezzee may, in its sole discretion and under guidance by relevant laws, from time to time implement a limit on the value of eGift Cards that may be stored in the Prezzee Wallet at any one time.
Prezzee will not replace your eGift Card if it is lost, stolen or used without permission or authorization. Please safeguard your eGift Card.
Retailer eGift Cards that you purchase through our Services are issued by participating third-party retailers (“Retailers”). Your purchase of each eGift Card is governed by certain terms and conditions established by the issuing Retailer in addition to these Terms. Retailers may set expiration dates for Retailer eGift Cards in addition to other restrictions and requirements. Please review all applicable Retailer terms and conditions prior to the purchase of any Retailer eGift Card. If you have questions relating to the applicable Retailer terms, please contact the issuing Retailer. As the issuers of Retailer eGift Cards, Retailers (and not Prezzee) are fully responsible for all aspects of their Retailer eGift Card programs. Retailers are responsible for all liabilities and costs suffered by you or any other party caused – directly or indirectly – by the Retailer or their products or services. We have no obligation to resolve any dispute between you and any Retailer. Prezzee endeavors to work with reputable Retailers, however Prezzee holds no liability for the sale of products or services provided to you by a Retailer. In purchasing a Retailer eGift Card from an issuing Retailer, you waive and release Prezzee and its subsidiaries, affiliates, partners, officers, directors, employees and agents from any liabilities arising from or related to any act or omission of a Retailer. Following the purchase of a Retailer eGift Card, Prezzee shall not be responsible or liable to you in the event a Retailer discontinues its Retailer eGift Cards or is unable to or refuses to redeem your Retailer eGift Card (including for reasons of their insolvency, external administration or forced closure).
A Recommended Retailer eGift Card allows the purchaser to recommend a particular Retailer eGift Card to their recipient, and it gives the recipient the opportunity to either have the Recommended Retailer eGift Card issued to them (if available on the Service at that time) or swap it for a different Retailer eGift Card of their choice of equal value (available on the Service at that time).
If a gift card purchased through Prezzee is a Recommended Retailer eGift Card, it will display the brand of the recommended Retailer and the product purchase page will include a notice that says “more choice, more joy! Your giftee will be able to choose where to spend their gift”. Recommended Retailer eGift Cards are issued by Prezzee at the time of purchase (and not by the Retailer that has been recommended to the recipient).
The Recommended Retailer eGift Card does not expire, and during this period it can be exchanged by the recipient for an eGift Card issued by the displayed Retailer (if available on the Service at that time) or for another participating Retailer eGift Card available on the Service of equal value.
To confirm that you wish to convert your Recommended Retailer eGift Card into an eGift Card issued by the displayed Retailer, select “keep this card” in your Prezzee Wallet. To swap your Recommended Retailer eGift Card to another Retailer, select “swap for another brand”. If the Retailer displayed on the Recommended Retailer eGift Card is no longer available on the Service, you can swap it for another participating Retailer eGift Card of equal value available on the Service.
Once you have confirmed your eGift Card selection and a Retailer eGift Card has been issued, this selection cannot be reversed or refunded except as required by applicable law. The Retailer eGift Card may have an expiration date (displayed in the Prezzee Wallet) and the terms and conditions of the selected Retailer eGift Card will apply.
For the avoidance of doubt, Retailer eGift Cards that offer a special promotion will not have the swap functionality and are not Recommended Retailer eGift Cards.
Not all Retailers participate in Recommended Retailer eGift Cards. The Retailers who participate in the Recommended Retailer eGift Cards are subject to change from time to time.
The Prezzee Smart eGift Card allows users to buy and send a non-reloadable value onto the Prezzee Smart eGift Card which can be swapped for another or multiple Retailer eGift Card(s) available through the Prezzee Service for the same amount. If you purchase multiple Prezzee Smart eGift Cards on a single day, the total amount that you load on all the cards may not exceed $10,000. There are no fees associated with the Prezzee Smart eGift Card. Prezzee Smart eGift Cards are not redeemable for cash and no refunds will be provided for Prezzee Smart eGift Cards (except as required by applicable law).
Accepted forms of payment are debit and credit cards approved by Prezzee, for example Visa, MasterCard, American Express, JCB and PayPal. Prezzee reserves the right to make changes to the payment methods available for use without notice. eGift Cards may not be purchased with cash. Unless indicated otherwise, the purchase of eGift Cards will be fully billed at the time the eGift Card is purchased by you. Prezzee uses a third-party PCI compliant payment processor and we do not hold any financial information. If your payment cannot be verified, is invalid or otherwise unacceptable, your order may be suspended or cancelled automatically. Any problems encountered in the processing of your order are not the responsibility of Prezzee.
Why do I see an extra $1 on my statement?
When you attempt to store a card to be charged later, our payment processor may send over a request to your issuing bank for either a $0 or a $1 authorization to verify that the card is issued and the bank will allow it to be authorized. Our payment processor will first attempt a $0 authorization. If the $0 authorization fails, they will then attempt a $1 authorization. Regardless of whether or not the authorization is accepted or declined, we will reverse the amount immediately thereafter it is charged. Some people may still see an authorization for $1 on their credit card statement. The important thing to remember is that this is not a charge, and it will disappear from your statement. Depending on the bank, it will be removed anywhere from a few minutes to a few weeks.
All eGift Cards sold via our Services are activated at time of purchase. Activated eGift Cards will be available within approximately 30 seconds however additional time may be required for certain activations and are subject to each Retailer’s own terms and conditions regarding activations. If your eGift Card has not been activated within 5 minutes of purchase, please contact us here. In rare cases it may take up to 24 hours for activation to occur, we appreciate your patience.
Please choose your eGift Card carefully as we do not allow exchanges or offer refunds on eGift Cards.
Prezzee is not responsible for the refund of the purchase price or return of any products purchased from Retailers.
Safeguard your eGift Card as it has value. eGift Cards that are lost, stolen or used without authorization will not be replaced or refunded. If you lose your mobile device please contact us immediately so we can attempt to put a hold on your account. If someone without authorization has partially or fully redeemed your eGift Card(s) while your mobile device is lost or stolen, Prezzee shall not be liable.
You are responsible for the use and safety of your eGift Card. Protect your eGift Card information by viewing it in privacy to ensure no one views and records your eGift Card information. We strongly encourage all users to have a passcode on your mobile device.
Prezzee attempts to be as accurate as possible in providing Services, however sometimes errors may occur. We do not represent or warrant that any description, eGift Card, Retailer or pricing information displayed on our Service is accurate, complete, reliable, current or error-free. In the event of an error caused by us, we will attempt to correct it as quickly as possible and revise your order accordingly.
You are not permitted to purchase products or services from Prezzee if you are a person that is listed or designated in any economic sanctions laws, regulations, orders, embargoes or restrictive measures administered, enacted or enforced by the Canadian Government, including Global Affairs Canada (and any successor thereto), any sanctions or requirements imposed by, based upon the obligations or authorities set forth in, Canada’s United Nations Act, the Special Economic Measures Act (Canada), the Justice for Victims of Corrupt Foreign Officials Act (Canada), the Criminal Code (Canada), and the Freezing of Assets of Corrupt Foreign Officials Act (Canada), in each case, as amended from time to time, including any person named on the “Consolidated Canadian Autonomous Sanctions List” produced by Global Affairs Canada: Consolidated Canadian Autonomous Sanctions List (international.gc.ca).
